Terms of Use

By accessing or using ISMGenius, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you must not use the service. These Terms constitute a legally binding agreement between you and ISMGenius (operated by JJcoded).

To use ISMGenius, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account. Accounts are personal and must not be shared.
• Notifying us promptly of any unauthorised access.

If you are under 16 years of age (or the minimum age required by applicable law), you must have the consent of a parent, guardian, or authorised school representative to use the platform. Paid subscriptions may only be purchased by someone who is at least 18 or has the consent of a parent or guardian who accepts these Terms.

ISMGenius is an AI-powered educational tool that provides rubric-aligned feedback on student assignments. The feedback is generated using artificial intelligence and is intended as a supplementary study aid only.

ISMGenius also offers AI content detection and plagiarism scanning features. These tools analyse submitted text for patterns commonly associated with AI-generated content or potential plagiarism against publicly available sources. Detection results are probabilistic estimates and should not be treated as definitive proof of AI authorship or plagiarism, nor used as the sole basis for any academic-misconduct decision.

ISMGenius does not replace teacher assessment, official moderation, or institutional academic judgment. We make no guarantees regarding grade outcomes, assessment results, admission decisions, or the accuracy of AI detection or plagiarism scores. You acknowledge that AI-generated feedback and detection results may contain inaccuracies — including incorrect band placements and estimated marks — and should be used as guidance alongside your own judgment and your teachers' advice.

Free accounts have usage limits and automatic deletion of reports after approximately 30 days; current plan limits and features are described on the Plans page and may change as the service evolves.

ISMGenius is designed to support your own learning — it reviews work you have already written; it does not write assignments for you. You are solely responsible for:

• Complying with your school's and QCAA's academic integrity and AI-use policies, including any requirement to disclose the use of AI-assisted feedback tools.
• Ensuring all work you submit for assessment is authentically your own.
• How you act on feedback, estimated marks, or detection results provided by the platform.

Educators using detection features agree to treat results as a screening signal only and to follow fair processes — detection scores must never be the sole basis for penalising a student. See our Academic Integrity guide.

You retain full ownership of all content you upload to ISMGenius, including assignment files, rubric documents, and pasted text ("User Content"). You must only upload content you are authorised to use — including any rubric or task sheet — and you are responsible for ensuring your upload does not infringe others' rights.

By uploading User Content, you grant ISMGenius a limited, non-exclusive, non-transferable licence to host, process, and display your content solely for the purpose of providing the service to you. This includes sending your content to the third-party AI services described in our Privacy Policy (Google Gemini for feedback generation; Winston AI for detection scans you request). We do not use your User Content for any other purpose, including training AI models or advertising.

You agree not to:

• Upload content you are not authorised to use or that infringes third-party rights.
• Upload another person's work to detection scanning without lawful authority to do so.
• Submit malware, viruses, or any harmful code.
• Attempt to gain unauthorised access to the platform, other users' data, or its systems.
• Use the service for any unlawful purpose.
• Interfere with or disrupt the integrity or performance of the service.
• Circumvent rate limits, usage restrictions, plan entitlements, or access controls, including by creating multiple accounts.
• Scrape, harvest, or bulk-extract data from the platform, or resell access without our written consent.

Certain features of ISMGenius require a paid subscription. Payments are processed through Stripe. By subscribing, you agree to the pricing and billing terms presented at checkout. Prices are shown in the currency stated at checkout and include GST where applicable.

Subscriptions renew automatically unless cancelled before the renewal date. You can cancel anytime via Settings → Manage billing; cancellation takes effect at the end of the current billing period and you keep Pro access until then. We may change pricing with reasonable advance notice — changes apply from your next renewal.

Promotions. Pro passes, referral rewards, and detection credits are promotional benefits: they have no cash value, may be time-limited, are non-transferable unless the promotion says otherwise, and may be withdrawn in cases of abuse. Detection credits included with a plan reset or accrue as described on the Plans page and expire when your account is closed.

Refunds. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a refund or other remedies provided by law. Beyond your statutory rights, refunds for change of mind are assessed case-by-case — contact support@ismgenius.com.

All rights, title, and interest in the ISMGenius platform — including its design, code, branding, and documentation — are owned by ISMGenius and its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent. Feedback reports generated for you may be used by you for your own study purposes.

To the maximum extent permitted by applicable law, the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure, or that any feedback generated will be accurate, complete, or suitable for any particular academic purpose. Estimated marks and band placements are AI predictions, not official assessment. AI detection and plagiarism scores are probabilistic estimates only and may produce false positives or false negatives. ISMGenius is not liable for academic or disciplinary consequences arising from reliance on feedback or detection results.

To the maximum extent permitted by law, ISMGenius shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service, including but not limited to loss of data, loss of profits, or academic outcomes.

Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of AUD $50 and the total fees paid by you to ISMGenius in the twelve (12) months preceding the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other liability that cannot be excluded or limited by law.

We may suspend or terminate your access to ISMGenius if you breach these Terms or if we reasonably believe your conduct poses a risk to the platform, its users, or third parties. Where practical, we will give you notice and an opportunity to remedy the issue first. If we terminate without cause, we will refund any prepaid fees for the unused portion of your subscription.

You may close your account at any time from the Account Deletion page or by contacting support@ismgenius.com. Upon termination, your right to use the service ceases and your data is handled as described in our Privacy Policy. We may retain certain records as required by law.

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any disputes arising under these Terms.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective" date at the top of this page and take reasonable steps to notify you (for example, in the app or by email). Your continued use of ISMGenius after any changes constitutes acceptance of the revised Terms. If you do not agree to a change, you may close your account before it takes effect.
