Terms of Use

By accessing or using ISMGenius, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you must not use the service. These Terms constitute a legally binding agreement between you and ISMGenius (operated by JJcoded).

To use ISMGenius, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account. Accounts are personal and must not be shared.
• Notifying us promptly of any unauthorised access.

If you are under 16 years of age (or the minimum age required by applicable law), you must have the consent of a parent, guardian, or authorised school representative to use the platform. Paid subscriptions may only be purchased by someone who is at least 18 or has the consent of a parent or guardian who accepts these Terms.

ISMGenius is an AI-powered educational tool that provides rubric-aligned feedback on student assignments. The feedback is generated using artificial intelligence and is intended as a supplementary study aid only.

ISMGenius also offers AI content detection and plagiarism scanning features. These tools analyse submitted text for patterns commonly associated with AI-generated content or potential plagiarism against publicly available sources. Detection results are probabilistic estimates and should not be treated as definitive proof of AI authorship or plagiarism, nor used as the sole basis for any academic-misconduct decision.

ISMGenius does not replace teacher assessment, official moderation, or institutional academic judgment. We make no guarantees regarding grade outcomes, assessment results, admission decisions, or the accuracy of AI detection or plagiarism scores. You acknowledge that AI-generated feedback and detection results may contain inaccuracies — including incorrect band placements and estimated marks — and should be used as guidance alongside your own judgment and your teachers' advice.

For approved teachers, ISMGenius also offers the Educator Toolkit, which applies the same feedback and detection features to a whole class at once and adds a moderation step in which the teacher confirms every mark. Section 6 sets out the terms that apply to it.

Signed-in users can also join the ISMGenius community, a moderated space for discussing study and sharing resources with other students. Section 8 sets out the terms that apply to it.

Free accounts have usage limits and automatic deletion of reports after approximately 30 days; current plan limits and features are described on the Plans page and may change as the service evolves.

ISMGenius is designed to support your own learning — it reviews work you have already written; it does not write assignments for you. You are solely responsible for:

• Complying with your school's and QCAA's academic integrity and AI-use policies, including any requirement to disclose the use of AI-assisted feedback tools.
• Ensuring all work you submit for assessment is authentically your own.
• How you act on feedback, estimated marks, or detection results provided by the platform.

Educators using detection features agree to treat results as a screening signal only and to follow fair processes — detection scores must never be the sole basis for penalising a student. See our Academic Integrity guide.

You retain full ownership of all content you upload to ISMGenius, including assignment files, rubric documents, and pasted text ("User Content"). You must only upload content you are authorised to use — including any rubric or task sheet — and you are responsible for ensuring your upload does not infringe others' rights. Where you upload work authored by someone else, such as a teacher uploading a class's assessment drafts, ownership stays with the author and the additional terms in Section 6 apply.

By uploading User Content, you grant ISMGenius a limited, non-exclusive, non-transferable licence to host, process, and display your content solely for the purpose of providing the service to you. This includes sending your content to the third-party AI services described in our Privacy Policy (Google Gemini, OpenAI, or OpenRouter for feedback generation; Winston AI for detection scans you request). We do not use your User Content for any other purpose, including training AI models or advertising.

What you post in the community is User Content too, and you keep ownership of it. By posting it, you also grant ISMGenius a non-exclusive licence to host it, display it to other signed-in members, and check and moderate it as described in Section 8, for as long as it stays posted. You must only post material you have the right to share.

The Educator Toolkit is available to approved teachers on an Educator plan. It lets you build a class roster, upload your students' assessment work, generate rubric-aligned feedback for the whole class, and moderate that feedback before anything reaches a student. The following terms apply in addition to the rest of these Terms whenever you use it.

• Authority to upload. You may only add a student to a roster and upload their work where you have your school's authority to do so and doing so is consistent with your school's policies, including any notice your school gives students and parents about the tools it uses. You are responsible for that authority; we have no relationship with your students and cannot obtain it for you.
• Keep the roster minimal. A student record needs a label and, optionally, a school-issued reference — initials or a student number are enough. Do not enter student contact details, health information, or other sensitive information. The Toolkit does not ask for them and does not need them.
• You remain the assessor. Generated feedback, criterion judgements, and suggested marks are assistive drafts. Nothing is released to a student unless you release it, and every mark is yours to confirm, change, or discard. Suggested marks are not QCAA results and must not be presented to students or parents as though they were.
• Integrity readings are a screening signal. AI-likelihood and source-matching scores are probabilistic and must never be the sole basis for an academic-misconduct finding or a penalty. Follow your school's process and speak to the student. See our Academic Integrity guide.
• Collaborators. If you add a co-teacher or a view-only colleague to a class, you are responsible for that choice and for removing them when their access should end.
• Deletion is immediate and destructive. Deleting a student, an assignment, or a class removes the uploaded files, cached results, feedback versions, and integrity scans together, and it cannot be undone by us.

Where a teacher uploads student work, the school determines the purpose for which that information is handled and remains accountable for it; we handle it only to provide the Toolkit. You agree not to:

• Upload content you are not authorised to use or that infringes third-party rights.
• Upload another person's work to detection scanning without lawful authority to do so.
• Submit malware, viruses, or any harmful code.
• Attempt to gain unauthorised access to the platform, other users' data, or its systems.
• Use the service for any unlawful purpose.
• Interfere with or disrupt the integrity or performance of the service.
• Circumvent rate limits, usage restrictions, plan entitlements, or access controls, including by creating multiple accounts.
• Scrape, harvest, or bulk-extract data from the platform, or resell access without our written consent.
• Use the community to harass, threaten or deceive anyone, to collect other members' personal information, to impersonate ISMGenius staff, a teacher or anyone else, or to advertise or sell anything.

The ISMGenius community lets signed-in users post messages, questions and links to study resources in shared rooms that other signed-in users can read. It is moderated by ISMGenius staff. The following terms apply whenever you use it, in addition to the rest of these Terms.

• Community Guidelines. To post, you must agree to the Community Guidelines, which form part of these Terms. If the Guidelines change in a way that matters, we will ask you to agree again before you post.
• What others can see. Your display name, anything you choose to show on your profile, and everything you post can be read by other signed-in members. Don't post anything you would not want them to see, and never post contact details or anything that identifies another person.
• Assessment stays yours. Do not post, request, trade or sell assessment responses, drafts or exam content, and do not offer to write or finish someone else's work. This is academic misconduct under QCAA rules whether or not money changes hands, and we remove it.
• Moderation. Posts are checked automatically when they are sent. We may hold a post for review, remove it, lock a thread, or pause or remove your access to the community, with or without notice, where we reasonably believe the Guidelines or these Terms have been broken or someone's safety is at risk. We are not obliged to review everything that is posted, and a post staying up does not mean we agree with it.
• Other members' posts. Advice in the community comes from other members. It is their view, not ours, and it may be wrong. Check anything that matters, such as deadlines, AARA, word counts or ATAR rules, with your school, QCAA or QTAC.
• Helpers. Members can offer to help in a subject, and are then labelled Helper in that subject's room. Helpers are students volunteering their time. They are not ISMGenius staff, teachers or tutors, we do not check what they know, and their answers carry no more weight than any other member's. Helping does not change the rules, and a helper must never write or check assessment for someone else. We may remove the label from anyone.
• Links. Links shared by members lead to sites we do not control. We are not responsible for their content.
• Leaving. You can edit or delete your own posts at any time. If your account is closed, your community profile, posts and reactions are deleted.

Certain features of ISMGenius require a paid subscription. Payments are processed through Stripe. By subscribing, you agree to the pricing and billing terms presented at checkout. Prices are shown in the currency stated at checkout and include GST where applicable.

Subscriptions renew automatically unless cancelled before the renewal date. You can cancel anytime via Settings → Manage billing; cancellation takes effect at the end of the current billing period and you keep Pro access until then. We may change pricing with reasonable advance notice — changes apply from your next renewal.

Promotions. Pro passes, referral rewards, and detection credits are promotional benefits: they have no cash value, may be time-limited, are non-transferable unless the promotion says otherwise, and may be withdrawn in cases of abuse. Detection credits included with a plan reset or accrue as described on the Plans page and expire when your account is closed.

Refunds. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a refund or other remedies provided by law. Beyond your statutory rights, refunds for change of mind are assessed case-by-case — contact support@ismgenius.com.

All rights, title, and interest in the ISMGenius platform — including its design, code, branding, and documentation — are owned by ISMGenius and its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent. Feedback reports generated for you may be used by you for your own study purposes.

To the maximum extent permitted by applicable law, the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure, or that any feedback generated will be accurate, complete, or suitable for any particular academic purpose. Estimated marks and band placements are AI predictions, not official assessment. AI detection and plagiarism scores are probabilistic estimates only and may produce false positives or false negatives. ISMGenius is not liable for academic or disciplinary consequences arising from reliance on feedback or detection results, or on advice posted by other members in the community.

To the maximum extent permitted by law, ISMGenius shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service, including but not limited to loss of data, loss of profits, or academic outcomes.

Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of AUD $50 and the total fees paid by you to ISMGenius in the twelve (12) months preceding the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other liability that cannot be excluded or limited by law.

We may suspend or terminate your access to ISMGenius if you breach these Terms or if we reasonably believe your conduct poses a risk to the platform, its users, or third parties. Where practical, we will give you notice and an opportunity to remedy the issue first. We may also pause or remove your access to the community on its own, as set out in Section 8, without affecting the rest of your account. If we terminate without cause, we will refund any prepaid fees for the unused portion of your subscription.

You may close your account at any time from the Account Deletion page or by contacting support@ismgenius.com. Upon termination, your right to use the service ceases and your data is handled as described in our Privacy Policy. We may retain certain records as required by law.

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any disputes arising under these Terms.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective" date at the top of this page and take reasonable steps to notify you (for example, in the app or by email). Your continued use of ISMGenius after any changes constitutes acceptance of the revised Terms. If you do not agree to a change, you may close your account before it takes effect.
